1.4 These Terms are governed by Czech law and the applicable EU regulations on consumer protection and online commerce.

2. DEFINITIONS
 

2.1 **“Platform”** refers to The Art Propaganda’s website where artworks are listed for sale.

2.2 **“Seller”** refers to artists or galleries who list artworks for sale on the Platform.

2.3 **“Buyer”** refers to individuals or businesses purchasing artworks through the Platform.

2.4 **“Order”** refers to a purchase transaction made on the Platform.

2.5 **“Dispatch Confirmation”** refers to the confirmation email sent once an order has been shipped.

 3. SCOPE OF SERVICES
 

3.1 The Art Propaganda acts as an intermediary connecting Buyers with Sellers. We facilitate transactions but do not own or directly sell the artworks listed on our Platform.

3.2 We curate artworks available for sale but are not responsible for the descriptions provided by Sellers.

3.3 By purchasing through our Platform, Buyers enter into a direct agreement with the Seller, with The Art Propaganda serving as a facilitator.

3.4 The Art Propaganda does not guarantee the authenticity of any artwork unless explicitly stated. Sellers are responsible for providing accurate descriptions and provenance information.

 4. ACCOUNT REGISTRATION
 

4.1 To purchase artworks, you may be required to create an account.

4.2 You must provide accurate and complete information when registering. Failure to do so may result in suspension or termination of your account.

4.3 You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

4.4 The Art Propaganda reserves the right to suspend or terminate any account suspected of fraudulent activity or misuse.

 5. ORDERS AND ACCEPTANCE
 

5.1 When you place an order, you make an offer to purchase an artwork. The order is only confirmed when you receive a dispatch confirmation from us.

5.2 We reserve the right to refuse or cancel an order for reasons including pricing errors, unavailable stock, or suspected fraudulent activity.

5.3 If an order is canceled after payment has been processed, a refund will be issued.

5.4 The Buyer is responsible for providing a valid shipping address. If delivery fails due to incorrect details provided by the Buyer, additional shipping costs may apply.

 6. SHIPPING AND DELIVERY
 

6.1 We primarily ship artworks within Europe at this time, but we may introduce international shipping in the future.

6.2 Shipping costs vary depending on the destination and are displayed at checkout before you complete your purchase.

6.3 Delivery times depend on the Seller’s location and courier services. Estimated delivery times will be provided at checkout, but delays may occur due to unforeseen circumstances.

6.4 Risk and ownership of the artwork transfer to the Buyer upon delivery.

6.5 For international orders, Buyers are responsible for any applicable customs duties or taxes imposed by their country.

 7. RETURNS AND REFUNDS
 

7.1 Buyers may request a return or refund within 14 days of receiving the artwork if the item arrives damaged or is significantly different from the description.

7.2 To initiate a return, you must contact us at marina@theartpropaganda.com with proof of the issue, including photographs.

7.3 The Seller will determine whether a refund or replacement is issued. The Art Propaganda will assist in resolving disputes but is not responsible for issuing refunds unless otherwise stated.

7.4 If a return is accepted, the Buyer is responsible for returning the artwork in its original condition and packaging.

 8. PRICING, TAXES, AND FEES
 

8.1 Prices listed on the Platform are in EUR and exclude VAT unless stated otherwise. VAT will be applied at checkout according to the Buyer’s location and applicable tax laws.

8.2 Prices are subject to change, but confirmed orders will not be affected.

8.3 The Buyer is responsible for any additional customs duties or import taxes imposed by their country.

8.4 We may charge a non-refundable service fee for transactions, which will be displayed during checkout.

 9. PAYMENT METHODS
 

9.1 Payments can be made using the methods displayed at checkout.

9.2 We process payments securely through third-party providers. We do not store payment details.

 10. ARTWORK AUTHENTICITY AND WARRANTIES
 

10.1 The Seller guarantees that the artwork is original and does not infringe on any third-party rights.

10.2 The Seller provides a warranty that the artwork will be free from material defects for 12 months, excluding damage due to improper handling, storage, or modifications by the Buyer.

10.3 Buyers are encouraged to verify the authenticity of artworks before purchase. We do not independently authenticate artworks unless explicitly stated.

 11. LIMITATION OF LIABILITY
 

11.1 The Art Propaganda is not responsible for any disputes between Buyers and Sellers beyond facilitating communication and resolution efforts.

11.2 We are not liable for any indirect, incidental, or consequential damages arising from the use of our Platform.

11.3 Our maximum liability for any claim related to an order is limited to the amount paid by the Buyer for that order.

 12. CHANGES TO TERMS
 

12.1 We reserve the right to update these Terms at any time. Changes will be effective upon posting on our Platform.

12.2 Continued use of the Platform after updates constitutes acceptance of the revised Terms.
